1.GENERAL INFORMATION
Welcome to the Ouwa Kids website www.ouwakids.lv (the "Website"). The owner of the Website is DIABELLA Ltd (hereinafter referred to as "the Company", "us" or "we"), Reg. No. 440103945948.
All content of the Website is the property of DIABELLA Ltd, any republication or use of any information must be agreed with DIABELLA Ltd. All rights reserved.
2.USE
Please review the basic rules listed below that apply to the use of this website and the purchase of products from it. By using the website, you agree to follow and be bound by these terms. In order to use this website and purchase our products, you must read, understand and accept the terms of use. These terms of use apply to all transactions you enter into with us. By placing an order, you automatically agree to our terms of use. If you have any questions regarding the Terms of Use, please contact us via email at ouwakids@gmail.com.
3.PRODUCT INFORMATION
All Ouwa Kids products featured on the Site are available from Ouwa Kids stock and are subject to availability until the relevant product is redeemed. Prices on the Website are quoted in Euro (EUR) currency for transactions with all countries. VAT is included in the price of the product. Please note that all prices and product information in the Ouwa Kids online shop are subject to change. The cost of the delivery service is not included in the price of the product.
4.COLOURS
We make every effort to reflect as accurately as possible the colour of the products offered on the website. However, as the actual colours of a product depend on your monitor and the image, we cannot guarantee that the colour of a product on your monitor will match the actual colour of that product.
5.PRIVACY AND SECURITY TERMS
DIABELLA Ltd cares about your privacy and the security of your personal data. By entering the necessary information when placing an order, the Buyer confirms that he/she is familiar with and agrees that the data provided by him/her will be used to enable the Seller to accept the Buyer's order and to deliver the goods in accordance with the requirements of the legislation of the Republic of Latvia. By entering the information, the Buyer agrees to receive notifications related to the processing of the Buyer's order to the e-mail address provided. The data provided by the Buyer will not be transferred to any third party or sold by DIBELLA Ltd.
DISTANCE CONTRACT
As the sale of the goods offered by us is made through an offer placed on the Internet, in accordance with Article 10 of the Consumer Rights Protection Law of the Republic of Latvia (CPRL), in such case, when the buyer places an order, a Distance Contract is concluded between the buyer and the seller.
The Seller of the goods offered in this online shop SIA "DIABELLA", Reg.No. 440103945948, on the one hand, hereinafter referred to as the Seller, and the person placing the order, hereinafter referred to as the Buyer, on the other hand, enter into the following Agreement:
The Seller undertakes to sell and deliver to the Buyer the goods as ordered by the Buyer.
ORDERING, DELIVERY AND PAYMENT
The Buyer shall order the goods through the Website, specifying the type and quantity of goods to be purchased. The Buyer has the option to pay for the goods using the payment tools integrated in the online shop or by paying the invoice prepared by the Seller and sent to the Buyer by e-mail corresponding to the order. The invoice shall be drawn up electronically and shall be valid without signature. The invoice must be paid within 2 days or it will be cancelled. The lead time for orders is 1-3 working days (depending on the type of product), after payment of the order.
ACCESS
Ouwa Kids offers delivery throughout Latvia and the European Union.
Delivery to Omniva parcel machines in Latvia - 2.79 EUR. Delivery time: 2-3 working days.
Delivery to Latvijas Pasts post offices in Latvia - EUR 3.79. Delivery time: 2-3 working days.
Delivery by courier to your home throughout Latvia - 6.90 EUR. Delivery time: 1-2 working days.
Delivery by courier to other EU countries (except Malta and Cyprus) - 14.90 EUR. Delivery time 7-8 working days.
FREE delivery to Omniva parcel machines throughout Latvia for orders over 50,- EUR.
RIGHT OF WITHDRAWAL
The Buyer has the right to withdraw from the Goods within 14 calendar days of receipt of the Goods by sending a letter of withdrawal to the Seller. The Seller shall send the form of the cancellation letter to the Buyer by e-mail upon the Buyer's request. The Buyer may exchange or return the Goods via Omniva's courier service. The goods must be sent to the Saulkrasti TOP parcel office. The return shipping costs shall be borne by the Buyer.
The Buyer has the right to refuse or exchange the ordered goods within 14 days of receipt of the order in the following cases:
Not used;
The product is packed in its original packaging with original trademarks and is complete;
The goods are not damaged, soiled, torn or otherwise defective;
The Buyer is obliged to return the Goods to the Seller within 7 days after the letter of withdrawal has been sent.
The Buyer cannot exercise the right of withdrawal if:
the goods ordered cannot be returned by their nature, or are perishable or expendable;
the goods ordered have been made directly for the Buyer to individual order (paragraph 22 of GC 255);
the Buyer has opened the packaging of an audio or video recording or computer software;
the goods are damaged, used or not in their original packaging.
Article 12(6) of the Consumer Rights Protection Law of the Republic of Latvia states that "the consumer is responsible for maintaining the quality and safety of the goods during the period of exercising the right of withdrawal". The Seller reserves the right to refuse the Buyer to exercise the right of withdrawal or to withhold the refund fee in the event that the goods have been damaged by negligent handling or failure to follow the instructions during use, if the original packaging of the goods has been lost or if the packaging of the goods is substantially damaged.
The Seller shall make the refund to the Buyer's bank account within 14 days of receipt of the goods.
In the event that the Buyer has discovered that the goods delivered are defective or faulty, the Seller shall bear all costs associated with the exchange or return of the goods.
DATA PROCESSING
By entering the necessary information when placing an order, the Buyer confirms that he/she is familiar with and agrees that the data provided by him/her shall be used to enable the Seller to accept the Buyer's order and deliver the goods in accordance with the requirements of the legislation of the Republic of Latvia. By entering the information, the Buyer agrees to receive notifications related to the processing of the Buyer's order to the e-mail address provided.
